Representative Commercial Litigation Cases

GAJANAN v. CITY AND COUNTY OF SAN FRANCISCO Case No. 16-554309, San Francisco Superior Court:  assisted Silverstein & Pomerantz in obtaining award of $5,265,562 in attorney’s fees against the City and County of San Francisco under the private attorney general statute, California Code of Civil Procedure Section 1021.5, June 2023. 

IN RE DMCA SUBPOENA TO CLOUDFLARE, INC., U.S. District Court for the Northern District of California Case No. 3:23-mc-80056:obtained documents via subpoena for identification of online infringer of client’s copyright rights, March 2023.

PACKAGING PERSONIFIED INC. v. ELECTRONICS FOR IMAGING, INC., San Francisco Superior Court Case No. 23-CV-410125:  Obtained immediate settlement of action filed on behalf of Plaintiff client in January 2023.

GAJANAN v. CITY AND COUNTY OF SAN FRANCISCO, Case No. 16-554309, San Francisco Superior Court, Statement of Decision entered December 23, 2019. As co-counsel with tax law experts at Silverstein & Pomerantz, won judgment after trial requiring the City and County of San Francisco to refund a $1.7 million tax penalty assessed against clients.  The judgment is the first known case to obtain waiver of assessed penalties under specific provision of the San Francisco Business and Tax Regulation Code. Assisted with appeal, which affirmed decision of trial court.

PEOPLE OF THE STATE OF CALIFORNIA, CITY OF SANTA ROSA v. DAVIS PROPERTIES, Sonoma County Superior Court Case No. SCV-265933.  Represented Receiver appointed to remediate health and safety violations on real property; property rehabilitated and sold in September 2022.

IN RE PAULINE MACDONALD/IN RE VALDEMAR MACDONALD, Santa Clara County Superior Court Cases No. 1988-1-PR-119817 and 1992-1-PR-128610:  May 2022.  Obtained payment of six figure settlement to client group.  Litigation history spanned many decades and several states.

ANGELA LAM v. DAVID MICHAEL, et al., San Francisco Superior Court Case No. CGC 16-552344: Obtained default judgment against defendants on behalf of client plaintiff, victim of internet fraud, in 2016, then through private investigative work located fraudster in Southern California and recorded abstract of judgment against fraudster’s real property in 2017.

Commercial Litigation Matters Settled Outside of Court

Representative Commercial Litigation matters settled outside of court:

  • Negotiated settlement of multi-million-dollar anti-dumping duties claim assessed against client limited liability company by Customs and Border Protection: August 2022.
  • Negotiated Service Agreement between Limited Liability Client and international loss adjusting company in 2015, then enforced required one year termination notice and obtained full payment of all invoiced work during that one-year period in November 2020.
  • Obtained six figure settlement of client’s claim against borrower under unsecured promissory note. Settlement included securing repayment obligation with deeds of trust against multiple real properties.
  • Obtained early termination of commercial lease on behalf of commercial tenant for de minimis payment.
